The Demise of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the crisis sparked by the presentation of a new 28-point plan for ending the war appeared – temporarily – to have been contained. A Washington representative spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its retaliation: a renewed assault of aerial bombardment on Kyiv.

The Rhythm of Peace Talks and Military Action

The succession of opposing developments captured the bleak nature of the outgoing year. By day, negotiation efforts are waged: optimistic declarations are delivered from various governments. Considerable effort is expended on managing specific proposals. By night, Russian leadership brutally reminds the world that, for them, war remains the primary tool for achieving "resolution".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was exposed. Ukraine is able to track missile launches from enemy soil, a capacity enabled by timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to counter approaching cruise missiles flew past – modern combat jets provided to Ukraine by European allies.

Shortly after, Kyiv's anti-aircraft weapons engaged: several firings fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, probably delivered by allied countries. Every launch shakes the surroundings, causing tremors. The instant of fear quickly becomes grim resignation: possibly the hostile projectile won't strike its target this time, sparing the city from ruin and additional electricity failures.

Continuous Dangers

Following this, a automatic firearm engaged a drone in the vicinity, part of a mobile-fire group – most likely Western-made equipment. Unfortunately, the shots failed to hit the enemy aircraft – it maintained course toward its destination.

Intermittently, this continued until dawn. Kyiv greeted the early updates: multiple fatalities, devastation and utility failures in numerous residences as a result of the evening attack. As typically, everyone still continued their routines – living the war. But those 24 hours encapsulated Ukraine's critical military reliance on external assistance – a need that regional partners are demonstrably unable to replace in the near term.

Ineffective Peace Efforts

The detailed framework from US administration sparked intense emotion, debate and profound anxiety – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and multilateral gatherings.

Every new approach from US leadership unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with other European capitals, effectively counters. They contain the crisis but never actually achieve victory. This pattern will, certainly, continue.

Political Considerations

It is easy to blame particular leaders of persistently promoting Russian terms. But that does not seem to be the whole story. American leadership works based on a assumption familiar among seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The US administration believes that it is impossible to force Russia to relinquish the territory that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, American administration does little to discourage Russia, through statements or actions, from assuming that the current condition will not shift further in its favour in the near future.

Divergent Views

Therefore, Russian leadership is convinced that the clock favors them – that Ukraine and its allies are approaching exhaustion. Their reason to accept conditions that does not give them the greatest potential benefit is almost completely absent. There may be numerous efforts to stop fighting, but they will continue as long as Russia's government remains completely certain in the conclusion.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing lives and land but avoiding a complete military breakdown until circumstances change in its benefit.

Present Conditions

Objectively, there are no genuine requirements for a armistice. Now, subjective factors are entering the equation: personal goals to broker a ceasefire and secure international recognition, and Kyiv's dual difficulties – on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any plan Kyiv finds unacceptable, so that their priority does not move to internal issues. And although their task will now be significantly challenging after recent developments, it remains quite doubtful that this will modify their basic position.

These conflicting dynamics are influencing discussions.

Assessment and Future

It took a mere seven days to terminate the proposed articles of the latest plan. Assertive and inconsistent approach of the matter by American leadership, resistance by Ukraine and the remaining European nations, along with soothing efforts of negotiators, and finally, current information leaks, all achieved their purpose.

While new proposals based on established approaches are forthcoming, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are based on Russian demands and show certain reluctance to modify developments, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the coming months, mainly require continued Western support.
